    They are obviously an ignorant bunch of wuckfits!

    Take them to the FOS and report them to the OFT and Trading Standards.

    Otherwise just ignore the morons. If they go to court they will make themselves look total arsholes and get ripped to shreds by a judge.

    LOL, yes. Some debt collectors are simply too stupid to reason with. :rotfl:In the end you waste more time and effort than it's worth trying.

    Thing is, if they're saying that it's not statute barred then they can enter a ccj or a default on my currently clear credit report can't they?

    Also, and might sound daft, but would it be better to send an email to the FOS, Trading Standards & OFT or write them?

    They can't just "enter" a CCJ. They might "try" to get one, but you would defend it on both grounds, and if what you say is true then you have enough to easily get a judge to throw it out.

    They cannot just add a default either. If they added one this late that would be a breach of the DPA, and you could complain and have it removed.

    They should be able to confirm what everyone has said here, and give you some reassurance that you are in the right.

    Hello there,

    I just wanted to reinforce Fermi's post #25. If they do try and take it further you'll be able to counter their argument pretty easily given the information you've provided about the debts. I know these letters can cause stress - I just wanted to tell you that this is a common tactic that we see a lot, and I don't think there's a great deal that you need to be alarmed over.

    Thanks guys. I have indeed just spent 30 minutes talking to a very helpful lady at National Debtline who has advised escalating the FOS too.

    She said that normally they advise getting it in writing that they won't pursue it further after a F&F but as I've got the letter I copied above then that shouldn't matter.

    I feel a bit calmer!! Monday my Noddle report refreshes so I'll be able to see if there is anything new on there.

    Right, off to talk to the FOS I go.
  • Looks like their most recent dribblings to you also completely failed to acknowledge the F&F payment you made with Rockwell. As far as I can see, that's the payment that matters, it was accepted by Rockwell and the matter was closed there and then, regardless of outstanding monies.

    Rockwell going out of business since then has zero impact on that payment. These latest bunch of shysters have obviously paid a couple of quid for the debt that doesn't exist and are trying the scare tactics.

    Frankly, you could send them a letter with a tape recording of you laughing, and they should be grateful they get that.

    FOS will give 'em a slap and tell them not to be so stupid.
