private eye pay and display parking fine

Hi, just hoping for a quick bit of advice.
Last week i parked in the pay and display car park if a local hospital trust for under 1 hour and had a ticket displayed on my dash for an hour. on return to my car no problem no penalty notice! In the past week i have throw the ticket away, why would i keep it i left the car park with no penalty notice?!
Today i have received a parking eye charge notice with pictures of my car entering and leaving the car park at times i don't dispute but i don't have the ticket as proof! Firstly can they issue retrospective pay and display charges? And secondly can i dispute this without the ticket?

    did you enter your reg number in the machine? Is it possible you mis-typed. PE have an ok record of cancelling if you suggest that the times match a reg which will be a digit out for example.

    Also worth saying here which hospital you are talking about

    it was the old general hospital site of the newcastle hospitals trust. I don't still have the ticket and it was just a pay and display machine no reg number needed. The only notice i have is the one received today with pictures of my car included!

    I think PE are a fairly new addition to that hospital, from what I hear this is prior to being rolled out to the other sites.

    No experience of it on this forum that I'm aware of so your best bet may well be to contact PALs at the hospital.

    PE usually only have ANPR cameras though and if there was no need to enter car reg then I'm confused as to how they know you didn't have a ticket.

    Might be worth me having a drive up there over the coming days to investigate.

    Please note that the Trust operates the above system in managing its estate and car parks. If you park inappropriately you may be issued with a penalty notice and fined.
    To avoid being issued with a penalty notice please observe the signs placed around the site and the following ‘good practice’ guide when parking on site.
    • Do not park on double yellow lines or hatched areas
    • Only park in a designated space
    • Park in an appropriate space eg not one that is allocated for other vehicles
    • Do not cause an obstruction to traffic or access to a building by parking inappropriately
    • Display your ‘blue badge’ when using disabled parking on site

    because I'm bored (seeing out the last few days of my gardening leave) I called the transport department and explained I had a 'friend' who had bought, paid and displayed and receicved a ticket.

    As suspected this is PE and ANPR.

    The hospital are adamant that you can't be issued a ticket without entering a reg number - I'd suggest you call them and complain to high heaven.

    IF that is correct and you can't be issued without entering a reg (which I doubt), then one possible explanation - as has happened at Northumbria NHS sites - is that someone prior to you tries to use the machine and enters part of a reg number, you arrive, enter nothing and receive your ticket but without realising you have to enter a reg number.

    All that said the best course of action is to appeal and get youyr POPLA code.

    Essentially you've had your Notice to Keeper.

    Contact the hospital as they may be able to cancel the charge - many do.

    And stick in a appeal to the PPC.

    Dear PPC,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) That you lack either any contract with the landowner at all or have one that does not grant you sufficient rights to levy charges.

    2) Your signage does not conform to the requirements of the British Parking Association Approved Operators Scheme Code of Practice.


    3) Your ANPR cameras are inaccurate and not operated to the standards required by the BPA code of practice.


    4) The charge does not represent a genuine pre-estimate of yours or the landowner's loss and as such is therefore punitive and unenforceable.

    In every case where this issue has been raised POPLA have accepted the appeal. You are fully aware that there is no prospect of your charge being upheld and you therefore have no case. Consequently, you should cancel this charge forthwith.

    If, however, you reject this challenge and insist on taking the matter forward I must caution you that I will hold you liable for the expenses I may incur (from that point onwards) in preparing any appeal application to POPLA, defending any court proceedings you may issue and dealing with any other correspondence from you save as may be required to communicate your withdrawal of the charge.

    These costs may include my time (which I will charge at the court approved rate of £18 per hour), the cost of stationary, postage, travel expenses, photography and legal fees etc. My charges become payable on invoice.
