Disciplinary help!

Hello all.

My other half has been in a job for two weeks now and was pulled into the office to tell he has been suspended. When he went in for his meeting on Monday he was told a customer had complained to Head Office.

Now he has been in a similar working position for 15 years with no complaints so I find it hard to believe and think maybe they just dislike him.

He has his final disciplinary tomorrow. Can he ask for the nature of the complaint? Also can he have prove of the complaint being made? I know with data protection they won't tell him any sensitive data. However at the end of the day he could lose his job with no proof that a call has been made?

Can anyone help? We are really stressing as he was made redundant from a big company who went bust last year. We have been really struggling and were over the moon that he had this good new job.

Any advice would be appreciated thank you!

    The first thing to say is that he can be dismissed for no reason at all other than discriminatory ones in the first two years of employment.

    Before a disciplinary meeting he should be told the nature of the alleged offence and he can take someone with him which is usually a colleague or union rep.

  • Well the company doesn't have a Union and he hadn't signed up for an independent one yet. He doesn't have anyone there he could take for support as the only staff he has been working with are all there as witnesses tomorrow. Four staff versus him alone. He doesn't know anyone else there he can ask?

    He lacks in confidence and feels like he is all on his own! I wish I could go with him!!!

  • In his first meeting on Monday, he said they asked him lots of questions about him enjoying the job and did he think he would succeed in the position etc etc. Also they told him that there would be a lack of trust if they kept him on. Is this relevant? X

    sorry to say but they can sack you for the first 2 years and not have to give a reason.

    As they are saying it's because of a complaint, then maybe it's true, as said they don't have to make up a reason, they could just sack him.

    But as they are using the complaint as the reason, yes they should provide what it is that he has meant to have done wrong, so he can answer it.

    But not sure what help it would be, if they want him gone, they will do it, so my advise is for him to either look for a new job with better employers or just hope they play fair, allow him to know what he complaint is, he can then answer it, and hopefully they will still want to employ him.

    Not sounding good if they have colleagues willing to confirm what's alleged to have taken place. :(

    Just to say for the future joining a union has little to do with whether the company recognises on, ( there isn't a thing as a company union). Obviously if there is one which is used by most people in a company it makes sense to join that one but you don't have to.

  • Thank you. I just don't feel like they have given him a chance after two weeks. He has only worked two jobs in his time (similar companies) and has worked for years in each of them. He has already had another offer from another company but took this instead. Now wishing maybe he had went with his heart instead of his head (more money in this position).

    Seems rather strange that colleagues who are not involved will be at his disciplinary meeting. What does the company's guidelines on disciplinary action say about this. He should have got a copy.

    He is in a superior position and the only staff he could take with him will be there anyway. He doesn't have anyone he can take in.


    He doesn't have any sort of disciplinary procedure as far as I am aware, just a letter with the time and date of the meeting.


    It's all very strange!!! To me it seems like they have just decided they don't want him for some reason and decided to get shot.

    Surely, he must have some idea of what its about. Do you think he is maybe actually keeping it from you.
