Can they do this??????

Hi All

I am in the process of selling a house that is jointly owed by myself and my ex-partner. The title deeds for the house reflect that each one of us owns an equal share

We are due to exchange and complete tomorrow but my ex is now claiming that I am not entitled to 50% of the profits from the sale, and has asked the solicitor to retain the money from the buyers until he and I can agree what proportion I am entitled to.

I have never heard of this before and wondered if the solicitor can hold my money on the say so of my ex-partner?

Any help would be greatly appreciated.

    If you haven't signed the contracts then they won't be able to sell the property without your consent. I would suggest you put off signing until you have spoken to a solicitor (not the one involved already) to find out where you stand. I don't think they can just decide not to pay you your share but I don't know the exact laws involved.

    if you do nothing, you will get a cheque in joint names. he cannot ask for a cheque in his name only, like wise, you cannot without the others consent.
