Newlyns threatening bailiff action at my lease company

    1st letter

    ACCOUNT BALANCE

    2nd letter (got a bit more detail)

    Dear Sir/madam

    We have been instructed by Leeds THT to recover the outstanding parking charges. We are a company specialising in debt recovery and
    undertaking to receive payment in full.

    PLEASE DO NOT IGNORE FURTHER ACTION WILL BE TAKEN.

    Yes the car is on a hire purchase plan, does that mean that they've not followed the correct procedure? It is difficult for me as I am going off what is told to me via a telephone call from a panicky finance manager. What papers does Newlyn need to have by law, in order for them to remove office material, to recover costs?     It seems like the finance company is only now making contact regarding these threats from Newlyns - yet no court order has been made. I would contact the financial obudsman and FCA regarding this matter as the lease is covered by the consumer credit act. Also tell the finance company that this is going to happen and that the threats of charging the OP with these amounts constitutes harassment when the debt has not been established through the court due to these parking charges being a civl matter.


    Why are Newlyn's stating that they are acting on behalf of the Leeds THT when the the parking charges are in the name of UKCPS?
    misrepresentation here so complaints to Trading Standards, the OFT also.


    Have you not complained to Leeds hospital regarding these charges to get them cancelled.

    UKCPS manage the car parks at Leeds, what grounds would they be for cancelling the charges?
  • The principal can always authorise the cancellation of the parking charges as UKCPS are merely the agents.

    I really think you are 'this close' to UKCPS sending court papers to the lease co. Is that what you want?!

    URGENTLY, NOW!! the lease co should be giving the name and address of the driver for all of the tickets IF THESE WERE ALL POSTAL PCNs (i.e. if there were no windscreen tickets). If this were me I would have pre-written the template letter with 'name/address of driver' and would be emailing it to the Lease firm tonight so they can send it tomorrow first class.

    If there were never any windscreen PCNs then the driver has to be sent Notice to Driver letters, in which case the driver CAN WIN all the appeals at POPLA with our help.

    Right now the lease co. is slowly slipping into the sticky stuff and could get court papers this week which will be too late to name the driver. If that's OK with you then leave it be and let them get sued. They have missed their chance to appeal, but if there were never any windscreen PCNs then the driver has NOT even appealed yet, and still can once they get sent their own Notice to Driver letters.


    Stop worrying about Newlyn and misunderstanding stuff about their separate Bailiff arm (which this is NOT).

    Oh dear, I did say twice 'if there were no windscreen PCNs'. But TBH this OP is now stuck between a rock and a hard place as I couldn't see a lease firm sucking up Court papers without trying some sort of 'breach of contract' claim in his direction afterwards. The OP may well need their 'lawyer friend' pretty soon.
