    Also should the notice to owner mention POFA 2012 because it doesn't. It does mention POPLA. Thought I saw that it should in a thread somewhere but couldn't see mention of it on BPA or POFA

    The soft appeal is find. I would change the final sentence to "I have nothing to add to this and expect either the cancellation of the charge or a POPLA code, nothing else"
  • Thanks. I will change the last part. I saw that elite had ignored someone else's appeal in another thread. I might resend it a few days later. It will be harder for them to claim to POPLA or a judge that the Royal Mail lost two letters.
  • Hi all, I can't seem to find the relevant info. If I want to email a complaint to DVLA what should the detail be.

    Am I to ask them to provide the date that Elite requested my details?
    Do I complain that DVLA should not have released my data after 56 days? Would they have been told of the original PCN date?

    A little unsure on DVLAs part in all this, have they broken rules as well as ppc

    Not sure I would bother, because we know the DVLA will reply that a PPC can request data later - outwith POFA 2012 deadlines - in an effort to find out who the driver was (LOL, and LOL again!).

  • I've had an email reply from elite that simply says lodge appeal through debt recovery plus ( even though the ntk was from parking collection services :rotfl:)

    Now don't want to get this wrong and give them a chance to say I've missed the 28 days or not followed their procedure so..


    1 do I just forward the soft appeal to parking collections services (they do mention popla on the ntk and say appeal to them)


    2 tell elite I've not had any letters from debt recovery.

    3 any other advise please

    Same company. Loads of threads about them all (and Zenith, all letter come from the same place).

    Just send the template first appeal from the NEWBIES thread to PCS and add a point #4 that they have missed the deadline for POFA 2012 so no keeper liability applies.

    I am the one that added point #4 into the template and sent it to PPC but they have just sent a one liner response to deal with DR+

    I have found a letter in response on pepipoo. But to be honest even with research I'm not sure I understand it and I don't want to send something until I understand it's contents. Here it is below

    I note the contents of your email and your request that I deal with Debt Recovery Plus

    For your information, I have not been contacted by Debt Recovery Plus but I have already contacted Parking Collection Services ( who actually issued the notice to owner on your behalf) and denied the existence of any debt
    They have been told to refer the matter back to you and not contact me again

    I will not respond to any communication from them again

    There is nothing whatsoever to prevent your company from considering my challenge.
    Refusing access to your industry's alternative dispute resolution procedure would be unreasonable and a breach of the Civil Procedure Rules

    It is well-established case law that, in the event of legal action, your company would be liable for the full costs of the claim regardless of outcome

    As far as I am concerned, I have made a valid challenge on the 17/04/14 and the clock is running
    If I do not receive a clear rejection along with a POPLA code within 35 days of the above date, I will regard the challenge as accepted and the matter closed

    If Parking Collection Services are now dealing with the notice I suggest that you pass my challenge on and alert them to its urgency

    Can anyone clarify where they break the civil procedure rules if they ignore my appeal. But once I understand it I think this could be the next email to Elite.

    Yep that would do the job nicely - it reads as though it's one of Gan's on pepipoo? The CPR require people to have used any Alternative Dispute Resolution and tried to resolve a case first - so they breach the CPR if they don't consider an appeal under these circs. The keeper is allowed to appeal to POPLA - the BPA Cop says so and we know it is the case. So they are also breaching the BPA Code of Practice.
