Card left on bus, money taken off after it cancelled

Basically I left my wallet on a local bus, I noticed within 5 minutes of leaving it on the bus and cancelled straight away.

However I had a charge on my card today for a cancelled hotel visit, the visit was booked about a hour after the card was cancelled despite the bank saying it was cancelled instantly, the hotel was no help and just treated me as a liar and refused to refund.

It turns out someone used my card to book a hotel, but didnt show up probably realised my card had been cancelled but now I am £40 out of pocket but I am on benefits and so that covers my food, and heating and electric etc for the week and a bit more.

What rights do I have

  • Why are you speaking to the hotel?

    Speak to the card issuer, point out the transaction is post your notification of it being lost and that it is a fraudulent transaction. Your card issuer will deal with the rest

    I would get nowhere with bank, had my card stolen a few years ago in student accomodation twice and after that bank refused to help saying twice in 2 years was suspicious so would not deal with any more claims(never got back the 2 grand stolen at that time)
  • Your rights are with your bank and need to be exercised with them.

    If you are unhappy with their service then complain and escalate to the Ombudsman if you arent happy with their response or if they dont respond to the complaint within 8 weeks
  • It would need to be done via the bank as they would give you a form to fill out. You have no contract with the hotel itself and why would they refund you because you say its been fraud? it needs to be done via the bank so that it can be investigated by both parties. Where i work i have had to deal with people saying this order was fraudulent and want us to process the refund because it was used with us, which we cannot do on the say so the customer, it needs to come from the bank themselfs.

    This makes no sense, a bank cannot refuse to deal with claims for fraudulent use just because you've claimed previously - if they don't want you to make any more claims they would close your account.

    As you've been told, you can use the bank's complaints process and the FOS, but I am doubting whether your story is true at all.

    Your posting history suggests that your bank cards get lost or stolen on a regular basis. You're very unlucky aren't you?

    It does look a little suspicious to be fair. And why didn't you protect your card after the first time? I've never lived in or been inside student accommodation (whether it be dedicated flats or an HMO) which doesn't have locks on bedroom doors.

    I'm not sure that's comparable with ops situation though, since op cancelled before the fraudulent transaction.

    Considering I have not posted in a long time and last time was about the ones in student accomodation you are looking at things the wrong way.

    And FYI I am autistic and suffer severe depression meaning I do not get out of the bed for days at a time and getting worse, its been a few years since card was last lost.

    The landlord at the property refused to put locks on the door quoting "its against the law" I knew he was wrong but I was so depressed I let it go, the 2nd time I had a lock but it was faulty and landlord was too lazy to fix it.

    I was lucky it never happened again after then moving to a flat next door to a dealer and had loads of stuff stolen in the period I lived there, since moving away from there and having own mail box had no stuff go missing.

    (Isn't there something about locks on doors changing the type of tenancy???)

    Get onto the bank, don't take no for an answer and explain you will take it to the financial services ombudsman - the complaint will cost them £500 even if the FSO finds in their favour.

    With that prospect they will in all likelihood simply refund the £40.
