    The loophole has now been closed, but this doesn't affect money you will be owed from when it was open (until March this year). The average refund is supposed to be approx £640 per claimant (although this will vary).

    However, this will not cover bedroom tax payable since March, so if you can't afford it, you should make a claim, via your council housing benefit dept., for DHP (Discretionary Housing Payment), which a lot of people are getting.

  • Just received the confirmation from the Council saying iam exempt from paying that now and i will get a full refund, iam also sending out the DHP forms to get the help from this march, thank you all so much i would not have had the guts to go to the council if it werent for you all X:T
  • I would have thought it would be up to the council to see whether the individual had been receiving HB, How can someone prove that, it is unlikely that anyone would keep records back 18 years, however, one would expect councils to have archived their records.

    Most don't have archives going back that far as they have no need to keep such records. We discovered that our computer records didn't go back that far but our document imaging system held copies of all benefit notifications issued since the system was installed.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
