Refund

Hello, I took my amplifier for repair to a local shop on the high street, its out of warranty. A few days later the guy from the shop calls and says it can be fixed, so I go ahead, as the price he was asking was significantly lower than purchasing a new system. He says it was a simple overheating probelm and he would replace a faulty fan.

Once the repairs were complete I went back to the shop, paid the repair fee and took the "fixed" appliance home.
Unfortunatley when I got home and plugged everything in, the problem was not fixed, in fact it was exactly how it was before I had taken it in!!

I called the guy and explained the situation, he said to bring it back in and he will take another look, now he's telling me the problem is alot more complicated..and he needs more time and he is contact with the manufacturer..this smells fishy to me...am I entitled a full refund?..I do not wish to spend any further money on the item as its just not worth it.

    It sounds like that the problem probably was the fan, however the overheating has caused damaged to the components within it.

    How old is the unit? It may be worth looking down the Sales of Goods Act route with the original retailer. Ask the repairer if he can produce a report to prove it is an inherent fault.

    However you did not answer my question..he says he fixed the problem, which he clearly has not, and I have paid him the money already..is this money now lost or am I entitled to some/all of it back?

    It would depend on the contract agreed. If he said that he could fix the unit and it would cost £XX, then he has failed to carry out the contract and he needs to cover the rest of the cost himself or refund the money.

    However, if he said that the fan is broken and it will cost £XX to replace it, then he has done what was agreed, however there are further repairs required.

    The difficulty comes in that the contract was verbal and trying to prove anything is difficult.
  • Thanks for the reply..who would have thought a simple service would come down to a war of words. Its supposed to be straight forward, I pay you to fix it, if its not fixed then you don't get paid!
    So what you are actually saying is, the repair guy can come up with numerous additional problems after he said the problem is fixed..that is total B.S ..pardon my language.
    Should he not test the unit before giving it back to the customer proclaiming it is repaired when in fact nothing could be further from the truth. I think this is all a scam, and not the right way to conduct business.

    I think it's an oversight at worst. Certainly not a scam.

    Depends how you look at it.

    You say it's not the right way to conduct business, this is hardly the right way to conduct a complaint! Your foul mouth will do nothing but cause problems here and with the shop.

    My thoughts would be, if my car overheats as the HG is blowing, the garage can fix the cause - but the consequential damage is not off their doing - for example, damaged injectors, glow plugs etc.
    But you say it's overheating still?
    So is the fan actually engaging? If not, is it possible there is an electrical fault caused by overheating?

    Personally i'd allow the chap to inspect it further, see what he says then once he has some form of diagnostics, discuss with him some options, expressing the fact you feel it should have been spotted before handing it back.

    I think its easier to refer to the situation as an oversight when its not your hard earned money thats potentially lost, nevertheless I intend to pursue a rational solution and see how this plays out. In the long run, its all about learning from mistakes and adapting accordingly.
