I apologise for making a new thread and yes I have been reading the newbie section as well as google and other forum posts. Including a helpful Watchdog video on youtube.
I received two invoices from them about a car I am the registered keeper of. I was not driving it at the events in question.
I keep reading conflicting statements from users and this is why I decided to make a post. I am in Scotland and I believe the law is slightly different here - as in I can tell them to rudely shove it and ignore it. Would I be correct in saying this as I would love to write them back some menacing (but not offensive) letters regarding their disgusting business practices?
Second if not and I actually do have to appeal properly in the form of a soft appeal should I just copy and paste one of the many pre-written appeals that people have put on this forum.
Some clarification would be great as I just today received the 'Final notice' from these idiots.
Thanks Stu

Don't name the driver. In Scotland POFA does not apply. They have to pursue the driver. At the moment they do not know who it is.0
-
I would be ignoring it as usual (in Scotland & NI) and let them carry on sending letters at approx monthly intervals for about 6 months or so - longer if you contact them.
If you do choose to write and tell them to get stuffed (or words to that effect) just be absolutely sure that you write as the registered keeper only.
As long as they don't know who was driving they are on a hiding to nothing - despite what nonsense they may threaten in subsequent letters.0 -
As already stated POFA does not apply in Scotland. All you need to do is stay quiet, make paper planes out of the threatening letters they'll send you, job done. A friend of mine got an invoice from PE in an Aberdeen car park - got a total of three letters from them before hearing nothing.
There's a greater chance of Hibernian winning the Scottish Cup than you getting taken to court.0 -
Good, that's what I wanted to hear. Will park there every day just so I can send them abuse and thanks for the free long stays that they offer. Also I made certain to inform them I wasn't the driver and let them know I wouldn't be telling them who was.
Now to harass the council for the fines they've been giving to people on a certain street in Perth that has the locals ready to pull out the torches and ptichforks - stopped on a double one way street where everyone and their dog stops to get money out the cash machine - this does not block anyone as it's a very wide street. I jumped out to go grab my pizza and I hadn't even crossed the street when the Gestapo showed up with ticket machine in hand. I subsequently lost the plot - I'm 6'3" and pretty big built and it required every ounce of strength not to knock that jobsworth out. He didn't even say, 'can't park here, please move'.
They just sit and wait there in order to rake in the £££, absolutely disgusting. Then the council complains no one shops on the high street anymore. Paid the whole thing in the smallest legal change possible.0 -

Parking in the street and getting a council ticket is a very different ball-game.
Far be it from me to condone such activities of course, but in Aberdeen for example most of the yellow-line road markings are non-compliant, and/or the signage is wrong.
The parking bays throughout Aberdeenshire are simply wrong - they have the wrong end-markings and double white lines where single lines are required.
The wardens (Traffic Officers or whatever they are called these days) know full well that the lines are non-compliant and just smile.
I had a genuinely pleasant discussion with one guy who said it was simpler just to cancel the tickets for those folks who appealed (quoting the correct legislation and including photos) that it would be to correct all the mistakes and lack of maintenance that the white and yellow line workmen had made.

If Aberdeen Council know that the lines are non-compliant, is that not taking money by deception?0 -
Eh??!Some clarification would be greatall you actually needed to do was read this sticky thread https://forums.moneysavingexpert.com/discussion/4816822
How did the Scotland section in that sticky, plus the Watchdog video linked there, not clarify? Strange and difficult to keep on top of the forum when every second new poster wants the same advice that's ready in the FAQs sticky, Scotland section and all. Written and updated recently, clearly not old advice. Yet the last 3 threads I have seen need it to be written out again...eek...!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It would need a test case I think.
Aberdeen City Council and Aberdeenshire Council are not alone by any means - It's widespread thought the UK.
I travel widely throughout the UK and see a lack of sticking to the rules and requirements on a daily basis.
Missing end T-Bars and wrongly marked parking bays are everywhere.
Have a look and see if you spot some in your town?
If more people appealed against the council tickets then they might just tighten up on the road markings, but at the moment they just rake in the cash from folks who pay without question.0
