IF the courts decide that the LL hasn't complied with the tenancy deposit regulations, they MAY award the tenant UP TO 3 x the amount of the deposit by way of a penalty.

Thank you, that's much clearer.
I think my best course of action is to continue to send our written notice as we had said we would and await the LL response whilst seeking advice from the Local Citizens advice.
