PPI and Bankruptcy

Hi, i declared myself bankrupt back in 2005, everything was sorted through the Official Receiver and i was discharged from the bankruptcy after 3 years. Credit has been restored and i now legally don't have to declare the bankruptcy.
Natwest/RBS wrote to me back end of last year claiming i was owed some money for PPI. I filled in all the paperwork and sent it back - They sent me an offer which i accepted and as far as i was concerned, the cheques were on their way. I've been told numerous times, the cheques were written and sent on Jan 3rd. Still no cheques. I called them this morning, and they asked if i've ever been bankcrupt - I obviously said yes - They are now claiming that the money they offered for the PPI can be appplied against any debt that was outstanding from the bankruptcy? Is this correct? Should they not have informed me, that this has happened? Surely the offer of the PPI should have been calculated on how much PPI was paid on the balance? They can't offer me money for PPI which hasn't been paid?! HELP!!!!

  • Did the PPI relate to a loan that was taken out before you were bankrupt? If it did, then you are not entitled to this money. See http://www.bis.gov.uk/insolvency/news/news-stories/2012/apr/ppi-mis-selling-claims-and-bankruptcy.

    If the PPI was mis-sold after you were discharged, then it should go to you.

    You do in some circumstances. Some ask "have you ever" as there can be issues related to pre-bankruptcy assets.

    Thats unusual. The CCL they have been issuing say you could have. Not you actually have been.

    If the PPi was paid before you went bankrupt then you have no legal right to the redress. It goes to the creditors that lost money when you went bankrupt.

    You are only entitled for redress on premiums you may have paid after you were discharged.
