Private road costs, please help

Basically it is a little close of 5 houses with a brick / blockwork drives and access.
From what I understand everyone was made aware of a service charge to pay this maintenence company when they all first moved in to the new close. No-one paid anything and being so new no work was required, it's not until now when our seller is trying to sell that the deeds have thrown up that the management company must be made aware of any transfer prior to sale so that they can inform the new owner of any implemented scheme.
The problem is:
We need permission from a company that no longer exists before they can sell and us buy.
If it is all sorted I need to find out if the close had an adoption date from the council or if it's always going to be unadopted, in which case need to factor in any maintenance costs / schemes before we sign anything.
I'm guessing this is a rare scenario?0 -
I've recently bought in an "unadopted road" and, as I understand it, the law changed pretty recently that I don't have to bother myself about the drains. Reason being that local Water Authorities have had to take over dealing with this from a recent law change (1/2 years ago? from memory). At that point in history all drains became the responsibility of the local water company.
As for the rest...."hear no evil/see no evil" is obviously the way to go for private roads from what I can see. Blinkers on/earplugs in then....:cool: and I've taken the standard view here personally of "It aint down to us if the Council hasn't adopted the road". Sometimes you just have to take the Realistic View and think "Anyone who tries to sue us for an accident THEY weren't careful enough to avoid is one person up against (at least) several of us" and forget about the current Politically Correct Climate.
Permission from the maintenance company before they can sell, however, is something I've never heard of before. I doubt it will be a problem to you personally....but worth checking that bit out a little more thoroughly.
EDIT: it isn't a rare scenario at all to have an unadopted road. It seems to be pretty frequent (from memory I think it involves over 1 million people...). What I have never heard of before is that "permission to sell from a management company" scenario.0 -
