Car craft advise please

Hi
I have sent my car into carcraft to be fixed as I bought my car from here, a month after I bought the car I had problems with the DPF which they never put right leaving me with a broken car for a year. They have had my car a month telling me it's going to cost £2100 to fix I told them to get the part in but DO NOT fix the car without my consent. They rang me twice through the week and let me know the part for my car is in but they need £1500 deposit before they can fix it but then I had a voicemail a day later telling me they had fixed my car and will not release it until I pay full amount, and they are adamant I have them permission when I clearly haven't as I can't afford that sort of money! Any suggestions about my rights please.:mad:

Yes instruct them the dispute will be sorted via the county court and sale of goods act as this is a fault they have refused to rectify from a month after the sale.
If they dont want to release the car repaired at the end of what has been an 11 month dispute then this is exactly what you prefer them to do as now you can sue them for the purchase price as they are refusing to return the car.
I bet within the hour, they are on the phone begging you to come and collect the car.Be happy...;)0 -
Thanks for the advice I have been on the phone all morning to them they are claiming I gave them permission which is in no way true at all0

Issue them a letter before county court claim to the value of the car under the sale of goods act.
Make your case in the letter about the 11 month mess about fixing the same fault state you believe you have provided them with every possible opportunity to rectify the situation since the fault was first reported within one month of taking ownership.
That now they claim to have finally repaired this "said and same" fault they believe they can charge you for the rectification.
This is contrary to the Sale of goods act and the position is unacceptable, if car craft refuse to return the vehicle repaired without demanding monies for what is a statutory legal requirement under sale of goods then the goods are deemed rejected.
The actions have resulted in loss of transport which is required for XYZ and this loss is also recoverable if they believe they can mitigate this loss they should offer to provide a replacement temporary vehicle.Be happy...;)0 -
DPF isn't even covered by the manufacturer warranty from new. Its a part that doesn't go faulty as such. It's only failure is caused by repeated short runs where the exhaust gasses do not get warm enough to burn off the deposits from the filter and then fail.
If the fault didn't occur for a month that would indicate that car usage patterns were the reason for the DPF failure.
I am surprised Carcraft even looked at the problem...0
