If she currently works evenings and has no children at home ....on what basis would you think she should be excused applying for jobs in the evening ?

The criteria is up to 90 minutes travelling time ....so if she has daily access to a car (eg can drive and husband isn't using it for work-which obviously he isn't) then the required distance would be greater than someone who couldn't drive so was reliant on public transport

I don't think she should be excused. I was asking the question, can they refuse evenings, out of curiousity more than anything else.

They will confirm if you have a driving licence and have use of a car. They will confirm the distance as per the RAC/AA website as to what is reasonable after driving for 90mins.
You would be expected to look for work up to those areas.

However if you said that you had to use public transport and didn't have a driving licence/no car, then the distance from home would be a lot less. It all depends on how serious you are in trying to find a job. To say that you have to take two buses which would get you say 5 miles from home in 90mins will seriously hinder your options. They may see that as being obstructive.
