The credit card company has asked
"To help me fully assess your claim, I will need you to get an independent report from a reputable source to support your claims that product is faulty. This report should specifically address your claims and include a cost for repair if applicable.
The company conducting the report should be VAT registered and have the correct credentials in this trade. If you need details of independent assessors in your area, please contact your local Trading Standards Office or Citizens Advice Bureau.
The Bank will reimburse you any reasonable cost of obtaining this report, upon being supplied with a valid invoice."
Do you think this is fair/normal or should I carry on with my total rejection ? I would prefer to reject the whole product. I am thinking that the CCC are going to say we will pay for repairs if they see that it is cheaper ..

"As previously advised, we require an independent report which substantiates your claim as without this report, we will be unable to fully asses your claim regarding any faults with the workshop.
We do not have anybody we can send from ourselves as the onus is on the cardholder to substantiate any claim made under Section 75"

Sale of Goods Act transfers the burden of proof to the consumer after 6 MONTHS from the purchase date. Prior to that the burden of proof lies with the retailer/supplier. So for under 6 months the retailer has to prove the goods were NOT faulty - after 6 months you need to prove they were. Section 75 should take account of relevant legislation (as far as I know). if you initiated your claim more than 6 months after purchase then the request is valid.

I think what your CC are asking for is unreasonable.
The roof is collapsing on a product that is days old. They have even offered to repair it which is perfect evidence of an issue existing. It doesn't require an independent report to show that there is something wrong with the product, in my opinion.If my post helped you in anyway, please hit the "Thanks" button! Thanks. But it is the credit card company asking me the consumer to provide proof. From the extract above are you saying that the credit card company should be asking the shed supplier to prove that there own shed is dodgy ?0

Yes - I think your credit company is being unreasonable. Ring them and ask them if pictures of the roof collapsing on a (1 week?) old shed is good enough for them to put forward a claim. If they still insist on a independent report, contact the http://www.financial-ombudsman.org.uk/contact/index.html for advice and see if the bank has the right to request an independent report when there is a clear major fault.If my post helped you in anyway, please hit the "Thanks" button! I threatened to take them to court and they came and took their shed away and gave me back all of my dosh. The CCC kept asking me for photos, reports, etc etc. Thankfully it was sorted by me and the company first.0
