help Reclaim Halifax monthly account charges

Hi all im trying to reclaim the monthly charges from Halifax for my ultimate reward current account (£15 pm) but just got this letter back and don't know if I can do anything else. Please Help me

    This is your final response from the Bank and it's a very comprehensive dismissal of your complaint with references to your contacting the Bank on several occasions to confirm cover was in place. You can hardly complain insurance was mis-sold if you continually referred to it over a period of years as necessary/desirable.

    You can, as the Bank says, refer your complaint to the Financial Ombudsman-but in all likelihood FOS will side with the Bank in this instance (and take approximately eighteen months to do so)

    Ok but just because I phoned them to see if I was insured for holiday and about my phone insurance Doesnt mean I wasnt mis sold it and yes I came FROM a fee free account but I thought this was because that account was no longer available. So is the FOS my only option now?

    Yes, unless you think they have mis-understood your complaint or you have any further details.

    It's solid evidence that you both wanted and needed the cover provided, how then was it mis-sold?

    Why would you think this? Do you have any evidence to support your contention that you thought a free account was no longer available? The Bank says that the free accounts remained available and your complaint is therefore "hearsay".

    Yes, but the Bank hasn't just failed to uphold your complaint-they have sent you concrete evidence which contradicts your assertions. FOS won't overturn such evidence unless you can counter it with your own verifiable proof of otherwise.

    It was opened in 2005 NOT 2009 like they are saying. when we were renovating our first house and getting a mortgage so I had a lot going on so I obviously didn't Listen very carefully when they rang and offeredd me the account

    I don't think the URCA was available in 2005.

    According to the Halifax reply which you have posted you registered a mobile phone on 27th March 2013 and immediately made a claim against this which was honoured. You previously telephoned on 11 April 2010 seeking assurance that you were covered prior to a holiday abroad. You clearly wanted the benefits of the account and have taken advantage of them. Why do you now consider the account to have been mis-sold? Your comment that you had a lot going on at the time is pathetic. You'll have to do better than this if you want to join the compensation bandwaggon.

    The letter says you changed your free current account to Ultimate Reward Current Account in 2009. Unless you can prove otherwise with documentary evidence (statements showing payments), there is no point contesting the Bank's records with simply your memory.
    The Ultimate Reward account was not launched in 2005.

    Yes, as I said earlier, this would seem to be pretty damning evidence that the OP both wants and needs the insurance aspect of the URCA.

    It was available from 2007 iirc.
