Naughty Bank of Scotland!

They incorrectly registered a search on my credit file last June and amazingly they refused to remove it...

(this is something which should be more regulated as banks can add as many searches as they choose in theory, and Equifax/Experian cannot remove without their approval)

So I complained to the ombudsman and they upheld the complaint, telling BoS to remove the search (again, they can only ask them to, not enforce anything!)

8 months on, they've paid me 2 cheques of £50 as an apology, fully admitted the mistake, but no matter how many times the ombudsman tell them to remove it, they simply won't follow it through.

Its a running joke now with my contact at the ombudsman - except its no longer funny because this search has affected my credit score.

Does anyone know if I can issue a small claim against BoS and claim financial damages, given I have so much supporting evidence of their wrongdoing, even from the watchdog?

    if they are going to 'pay' you £50 each time you go to the ombudsman then I think it's a nice little earner and I'd keep going back for more...
    just in case you need to know:

    Fair enough and I see your point but this search falls off your credit file in 5 months.

    1 credit search won't make a slightest bit of difference from a lenders point if view.
