If company ignores claim for 8 weeks

Options
I'm in the situation where I've sent initial PPI claim forms and the 8 weeks has lapsed. Another set of correspondence has been sent. How long do I have to wait legally before further action can be taken from this second correspondence? Do I have to wait another 8 weeks?:(

  • Not sure, but I'd hang in there a while.
8 weeks is nothing compared to 18 months or more with the fos.
  • You have not told us enough.

Who is the company and when did you take the PPI out?

Did you receive an acknowledgement of your original complaint? If not, they may never have received it.

You can wait forever "legally" since a PPI complaint is not a legal matter. If the Bank didn't receive your original complaint, then it's sensible to send another-otherwise, the only sanction you have available to you is to refer your complaint to the Ombudsman (which takes around eighteen months).
  • I agree with Moneyineptitude. Unfortunately, you cannot prove it was received.

I suggest you write again with a copy of the original complaint and say that if you do not hear from them within two weeks you will refer the matter to the Financial Ombudsman Service.

This time get proof of posting (free from the Post Office)

Whether you can take them to FOS depends on who they are and when the policy was taken out. That is why I asked.

You probably need to wait 9 weeks from when you send the reminder anyway as you cannot prove the original complaint was received. (FOS will accept proof of posting as reasonable evidence of receipt a few days later if the address is correct).
