Stockton Heath parking fine

I've read through a lot of threads on here and some are similar to my own position, I even saw a thread relating to the same carpark.
Basically I received a fine from Euro Car Parks for £90, reduced to £50 if pay within 2 weeks for parking longer than 2 hours. It was the evening of 30th December we went for a meal and parked from 7.30-11pm, I didn't realise there was a time limit as I've parked here many times before, just mustn't have been for over 2 hours.
The car park was practically empty anyway, although I know this probably doesn't make much difference.
I'm thinking to ignore this going from advice on here, new and old threads,and friends opinions, is this wise?

  • Wait for your Notice to Keeper and use the meantime to explore the threads - especially the Winning at POPLA bit.

    Then it will be time for a soft appeal to get your POPLA code where you will then win - as long as you follow the advice on this forum.

    Something along the lines of..

    Dear PPC,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) the charge is not a genuine pre-estimate of loss

    2) your signage does not comply with the BPA Code of Practice

    3) you do not have the authority or permission to issue invoices at this location

    These points and others will be raised with POPLA should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    You will be fully aware that there is little prospect of your charge being upheld at POPLA and I invite you to cancel the charge now, and save yourself the POPLA fee of £27.

    If you decide to continue to pursue this matter and reject this challenge then please supply a POPLA code. Please be aware that further points may be raised at POPLA.

    Please note that should my appeal be upheld at POPLA for any reason, I reserve the right to claim my expenses from you and my time in challenging this parking charge at the court rate of £18 per hour.

    The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Once you have your rejection from the PPC, come back and put your POPLA appeal together.

    Absolutely not, no there isn't and you will actually confuse newbies by saying this! There are no such threads since the Summer at least, and mostly not since Easter 2013. If you have randomly done a Google search and just read old stuff without looking at the dates then good luck with that approach, bearing in mind MSE forums have been going for years & there are obviously thousands of obsolete archive threads potentially out there! But it's a waste of your time to actually READ them - that sort of random searching is like Googling a newspaper name and reading an old pointless edition from 2011!

    Why didn't you just use an appeal letter from the dozens linked in the 'Newbies' FAQs thread posted by HotBring - and which was at the top of the forum all along? I don't understand why you wouldn't have read page one of current threads once you'd first found the forum, seeing as page one is only ever one click away from any thread (even an archive one). If you are unsure what I mean by 'one click' to page one, it's explained in my signature below. You could have got to the right advice so much quicker but at least you are here now and need to read the 'Newbies' FAQs thread for 'How to win at POPLA'.

    It is easy once you know how to click back and hop around the current forum, and read the sticky threads at the top.

  • Ok guys you know better than me. This forum has been helpful but there's a lot of info and it can get confusing!
    I've followed some of the links on here too which do say ignore but realise that might be old advice.
    Ill keep on reading and try and work out the best thing to do!

    The best thing to do is follow the advice given in post #3 by ezerscrooge but can you just confirm that it is a windscreen ticket you have received, or was it a postal notice to keeper?

    If the latter then appeal as advised now.
  • It was a parking charge through the post, haven't received notice to keeper yet.

    yes it is the same thing, you either get one on the windscreen, or one in the post
