Redundancy TUPE - Things don't seem quite right

I have been told that I am at risk of redundancy and that my consultation period of 30 days ceased on 11th Feb. I then have 3 months notice period to serve. However, the paperwork which I was given at my first consultation interview states that my notice period finishes on 4th April, surely this should be early May, as the 30 days has to run firstly and then the notice period begins. So, as it stands I am loosing out on 1 months PILON.

I am also annoyed that my hr dept have miscalculated my redundancy statement - calculated the compensation based on 4 weeks pay for every year of service and then added 3 months pilon on and then taken it off it seems, very incompetent. As the total figure is equal to compensation and that is all.

I was also wondering if I had a case for a grievance regarding these errors combined with the fact that we found out about the redundancy 2 months ago via a document that was emailed to myself and my colleague by mistake.

Or, shall I just get a corrected figure, keep my mouth shut and leave.

Very stressful time for all concerned and not being helped by these errors. Hope someone out there can offer some guidance.

    Until they issue a termination notice you are not on notice.

    if they want to set a termination date of 4April(this tax year) then you will be due PILON for any unused notice.

    The relevant date for the redundancy payment is the date of notice + the statutory notice(1week per year up to 12 weeks) or the termination date which ever is the latest.

    Don't forget accrued unused holiday up to the termination date, try for holidays for the full notice some places will give this because they don't know they don't have to.

    All a grievance does is give them a chance to correct, if they won't fix then you will need to go through the process.

    You need to consult, which is finding out the reasons for the proposed redundancies and a chance to make your case why they need to keep you.

    Two possibilities:
    1. c0ck-up not conspiracy. various people have differing notice periods and they've just got yours wrong
    2. Notice varies in different directions, ie you have to give 3 months but they only have to give 2.

    lala, you have been in consultation, that does not mean you have been selected for redundancy. The consultation period for you was a minimum of 30 days.

    If you have not been informed the outcome of the consultation then you are within your rights to ask when the outcome will be decided.

    Once you know the outcome then come back and post what they have told you.
