Notice to driver naming wrong make, colour and no specific location

Read and digested much relevant forum advice(for which this newbie thanks the posters) I have no intention of paying.(poor hard-pressed pensioner)
Tempted to write to the PPC as reg keeper drawing their attention to the errors. When they apply to DVLA their notice to keeper will be different from their notice to driver. Does anyone think this relevant especially as the britparkasses clause requires a specific location (yes they're members). I do appreciate they may have photo evidence of yellow line contravention, and will ask for this.
Any observations will be welcomed.

Makes no difference as parking on private land is unregulated. Just wait for the notice to keeper, who is the parking company ? And is this England or Wales ?

    Thanks

  • Yellow lines in private car parks have the same legal status as grafitti, there is no "contavention". They have just decided that you have broken one of their rules so they are trying to extract money from you.

You could mention the vague location when it's time to appeal (which is usually after a NTK arrives in the post). Check the newbies thread for a few smaller PPCs where I suggest the registered keeper appeals earlier to avoid later debt collector hassle & delays.

  • Thank you for your replies. On thinking further about this issue, it would seem to me that since the demand for money was made in the notice to driver, that a subsequent demand in a Notice to keeper should be congruent, otherwise it is a nonsense. This was in England and one of the more successful companies. My aim would be if possible to get the whole thing abandoned by them before it goes further. I guess the chances are slim?

if the pcn was on the windscreen, then by replying you negate the RK options and you are deemed the driver by default, so you always should wait for the NTK

this is all explained in here https://forums.moneysavingexpert.com/discussion/4816822

Well if you read the Newbies thread already linked you will see strong first appeals which have achieved exactly that. It's not the norm though - most go to POPLA and THEN we win (100% of the time). None of the companies are 'successful' against our appeals at POPLA unless their signage doesn't say the PCN is for 'breach/failure to comply'. Please tell us what the sign says, while you await the NTK.

Also as keeper you are probably best NOT referring to the windscreen ticket at any point unless you say you were a passenger or summat. The keeper replying to the NTK in due course should be writing as if that's the first they have known about it - not talking about differences with a ticket which was ignored...

Your best bet for a nice early cancellation is if there's an on-site retailer and you complain to them and they cancel it. Very common, as per the 'Successful complaints about PPCs' sticky thread. If there's an on-site retailer why not pop back for a word in the Store Manager's ear and if no joy, take a photo of the parking sign on your way back to your car, so you can tell us the wording? Also check for whether there is any entrance sign about parking (there has to be).
