Barclays Debiting My Account

    Hi All;

I paid a payday load off for my sister a number of months ago. She was in difficulties paying the extortionate rates (which yes she should have realised this when she agreed to the loan) so I agreed to pay it off and she pays me back over the following months. Everything is fine and all payments have been met.

    Then…

Last month a substantial amount of money was debited from my account. After a few phone calls to Barclays I found out that it was by the same payday loan company for whom I had made the payment to for my sister a number of months earlier.

I opened a case and after a few weeks the money was returned to my account by Barclays whilst they investigate. Now I have received a letter from Barclays stating that the resolution team have decided that for whatever reason that unless I tell them that I don’t agree with the decision the money will be re-debited from my account in the next 7 days.

Where I’m lost more than ever is that attached to this letter was a credit agreement in my sister’s name with her home address and signature on it dated after I settled the account originally.

I have now written back to Barclays stating that this Credit Agreement is clearly not in my name or has anything to do with me.

    As I understand it

I paid a payday loan off for my sister with my Barclays debit card

She has taken another payday loan out with the same company

She has failed in keeping up with the payments’

The payday loan company have taken the money out of my account. I believe using the details I gave when I made the original payment a few months earlier

What really gets to me the most is that for some crazy reason Barclays seem to think that despite all the information showing that this has nothing to do with me and that the money has been taken from my account without my authorisation. They say they are going to re-debit my account for the original amount.

    How can this happen?????

Have you spoken to the payday loan company about the issue?

I guess that they probably understand the situation differently to you, and have advised Barclays accordingly.
  • I'm actually more annoyed with Barclays than the PDL Company. I understand they want there money and will do what it takes to get it. Although not right how they have gone about it.

But the way Barclays have essentially sided with them at the moment and not with the person who has banked with them for years and who does not have there name on the Loan Agreement.

    It's just unbelievable

Something doesn't add up here. Wonga state that they can only accept payment from cards registered to the loan taker. http://help.wonga.com/articles/What_Is_external/Can-I-pay-with-someone-else-s-card/?q=Registering+a+card&l=en_US&c=Topics%3AContact_topics%2CMarkets%3AUK%2CProducts%3AWonga&cu=1&fs=ContactUs&pn=1

So how did OP manage to pay someone else's loan?
  • It's not Wonga
  • It's the Cheque Centre
  • When it originally happened I contacted the cheque centre who would not give me any details as I was not on their books as such. And quoted Data Protection

Sorry, don't know why I thought it's Wonga, probably because dotdash79 mentioned it.

Nothing I can see on Cheque Centre website that requires payments to come from cards held by the person taking the loan, so they seem to be happy to take the money from anyone.

You are right that you do not have a contract with the Cheque Centre but you / your sister have given them your card number. You should continue to tell Barclays that you don't have a contract and the payments are not authorised, and you should also inform the Cheque centre in writing that they are not authorised to take any money from your card as you have not given them your agreement to use your card (though they will probably say you have since at some stage you did).

Your real anger should be directed towards your sister, who, as you say, appears to have taken out a second PDL even though she wasn't able to pay back the first one.

Really? It's her business. She has taken a loan, but she hasn't given the card details to the company and nobody authorised them to take the money from the card that just happened to be on their records from the past.
The company is the first one to blame and to direct the anger to.
Barclays are the second as they are failing to protect their customer in a clear cut case.
