Parking eye pcn - Aberystwyth

Hello

The wife over stayed at a parking eye car park in Aberystwyth. She has just received the pcn with copies of the image from anpr. We have receipts from our shop at the stores on site.

I notice the process as changed since I last looked at this issue.

I have read the relevant threads and want to confirm I am following the process correctly.
1 - I plan to visit the store and complain to the manager and get CEO details etc.
2 - complain to car park owners.

If this fails write to parking eye. Does anyone have a template letter?
Should I wait for reply from store and or car park owner before writing to parking eye?
:p

Complaints and appeals should be done in conjunction with each other. Below is a template for you. But please read the sticky threads by coupon mad they will aid you.

    Dear Parking Eye,

As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to you company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

Please issue your cancellation within 35 days of this letter, or supply a popla verification code

    Faithfully

Well obviously don't miss your appeal deadline while waiting, and why even wait seeing as PE appeals can be done online in minutes? Do both at the same time.

I highlighted the 'template' question because that's what I thought I provide in the 'Newbies read this first' thread at the top of the forum. Is a dozen linked examples of first appeals not enough by way of example appeals? IMHO - sorry but felt it needs saying - for parking ticket appeals, verbatim templates are the work of the devil anyway, why the heck do people want to use a letter written for them that misses the main point (receipts) and which is so obviously a template when the PPC get it, that they don't take the appeal seriously? The PPCs must laugh when they get that same old template...nothing wrong with the points it makes but I am just astonished so many people here seem to want to use the same generic letter without so much as a tweak to push it in their favour.

You have receipts which will very likely kill it stone dead anyway (which you'd learn from reading the Newbies thread near the top of page one, with the other stickies - I appreciate you may have skim-read it already but seem to have missed the appeals advice about receipts). Other PE threads tell you that PE do cancel when they see over £30 in receipts, so it's a no-brainer, just write a simple two-liner online and attach copies. Why send a template and no receipts, when receipts will get it cancelled?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for the replies. Serious illness as taken over the family but I am still onto this. I have attended the stores my wife visited and they can't do anything so letters sent to head office.

I can't seem to find the land owner but I have details of the management company for the site so letters will be sent along with letters to the council/mayor.

I am just writing my 'personal' letter to PE based on some of the templates.

I have just completed the online appeal and plan to send this out to PE.

    Any thoughts

    Dear Parking Eye,

As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to you company is denied on the following:

    1) On 04th January 2014 I was using the Rheidol Shopping Centre to complete my fortnightly shop at the stores on the site. As you are fully aware there are limited spaces available and finding a space can take some time. On this day it took me over 10 minutes to find a space. I completed my shopping in a number of stores and returned to my car. Unfortunately I did not keep all of my receipts and purchases were made with cash. However I did make a substantial purchase in the Lidl’s store on site and I have attached the receipt to this claim. Lidl’s is a very busy store and they have limited check outs so queuing to pay can take sometime. After going to Lidl’s I made a purchase and returns some goods to Argos, another busy store. Leaving the car park is always a issue. Due to the location of the car park and the nearby traffic lights and roundabout the queues leaving the car park can usually be back logged for upto 20 minutes. On the above date this was the issue.

    2) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    3) Your signage does not comply with the BPA Code of Practice
    4) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

Please issue your cancellation within 35 days of this letter, or supply a popla verification code

I believe when appealing online you get an auto-response email. Alternatively just screenshot the page shown after the appeal is submitted.

Thanks. I didn't include email because I didn't want to be sent a load of emails, already had two letters a week apart.
