About to build an extension within 3m of neighbours. We get on well and they know what we're doing and have no objections.
Is it OK to not bother serving a party Wall notice?
Is it just an agreement between neighbours or is there a legal obligation to have this? and will building control or our builders want to know whether we have one?
Thanks. Just seems like even more unnecessary red tape and a license for surveyors to make money.

Party wall is a legal requirement but only if you build on the party wall. Within 3 metres I can't see how it's needed.0

Yes, you are required to serve a PWA if the work requires it. But if you don't, there is no legal sanction to prevent you carrying out the work except by means of an injunction obtained by the other party. Fundamentally flawed piece of legislation.No free lunch, and no free laptop

PWA could still apply depending on depth of foundations to be excavated amd whether the builders can work without overstepping boundary0
