Speeding Ticket Query (1st Time)

Hi All,

Just seeking a bit of advice really.

Got caught speeding on 29/12/13 13:33

Received letter today 15/01/2014 dated 13/01/2014

I have a company car.

70mph on a dual carriageway, I was doing 88mph picked up by "manned equipment"

Do I have an opportunity to dispute due to it exceeding the 14 day period by a few days?

  • No. The original NIP will have gone to the company or lease company whose car it is. They will have named you, and you got your own NIP. It's only the first NIP that needs to be received in 14 days.

    Whether in time or not, you MUST reply to the NIP or it gets messy for you. Don't try to be clever about it. If you want to dispute it, do so when they send the CoFP.

    ok thanks, Thought it would be worth checking. I assumed this was the first NIP, as it was addressed to me at my work address. There is no indication of how much the fine will be either. From Suffolk Constabulary.

    The fine will be a minimum of £100 plus 3 points on your licence. If you receive a FPT and admit the offence then it will stay at that. If you elect a court hearing or are summonsed then that is a starting point (max £1,000 + 6 points at the speed you were doing) and will also attract costs (should you be found guilty of course :) )

    If the company has put you down as the registered keeper, and it is the first NIP, then you can definitely challenge it as being outside the 14 days. You still have to nominate the driver, but send a covering letter if this is the case.

    You only get a fine if you go to court and are found guilty. You will either get a Conditional Offer of Fixed Penalty (£100 and 3 points), or possibly an invitation to attend a Speed Awareness Course (costs about £90 but no points), depending on how far you were over the limit, and how many points you have already.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    - This would be my first speeding offence.
    - According to the letter speed limit 70mph
    - My speed 88mph

    On the letter it says "You have received this notice as you are recorded as the OWNER/KEEPER/HIRER of the above vehicle or have been named as the DRIVER of the vehicle at the time of the offence.

    How can I check to see if this is the first NIP?

    Ask your company fleet manager who the registered keeper is, and whether the company (or a leasing firm) originally received a NIP and then nominated you as the driver.

    Have a look at bargepole's response. If you are the registered keeper then they are outside the 14 day period. If the vehicle is registered to the company or a lease company they will have provided your details therefore the NIP will be lawful provided they received it within the 14 day period.
