How to claim housing benefit as a lodger

I am about to move into a room within a house as a lodger, I will have access to bathroom, kitchen and my own bedroom and nothing else.

How do I go about claiming housing benefit?

    Is the main tenant at the property getting HB?

  • To claim housing benefit you must have spent at least 1 night at the property.

    To find out how much housing benefit you will be eligible for when you start work will depend on how much income you get.

    Suggest you have a look on your local council's website and see if they have an online benefit calculator. You will probably need to know how much tax and ni deductions you will be paying but you can again estimate these using one of the take home pay calculators you can find via google or other search engines.

    Sorry but pretty sure that if you do not have a formal tenancy agreement then you will not get HB.

    Lodgers are eligible for LHA - the OP has not said they do not have a formal agreement?

    A lodger/ tenant in a HMO should have a written agreement irrespective of whether they are claiming benefits or not.

    Is that the law?

    The reason I ask is that live-in landlords with lodgers are recommended to have an agreement in place to avoid conflicts, set out the terms of the notice period, rent, etc, but I didn't think it was a legal requirement.

    Was this bought in under HMO legislation.

    No, it's not the law to have a written agreement. A tenancy is DEFINED by the law, not by the contract. It is what it is.

    As long as the rental liability can be established, HB should be paid. It will be, at most, the LHA "shared room rate".
