Parking Fine

Hi, this is my first time on the forum. My wife came back from shopping today with a £90 private car parking fine (BPA firm). As she was walking back to the car the chap had just finished writing out the fixed charge notice which read:
Observation from 12:37:06 to 12:43:22, Time issued 12:43:28

The expiry time on the car park ticket 12:37

So by my calculations the guy was on the case 6 seconds after the end time and issued 6 minutes later. Any case for appeal??

    Its not a fine, just a speculative invoice.

    The BPA limited are not a regulator, nor a parking company but a trade association whos sole reason to exists is to further the interests of its members.

    First question: who was/is the parking company isuing the tickets?

    Second im assuming this is a written 'windscreen' ticket correct?

    (edit) Third ( and most important) Do not worry, panic, get upset etc etc, while its not a good idea to ignore these thickets if handled correctly they are nothing but a joke, all be it a very bad joke.

    Yet another edit:
    Do not respond the the hand written ticket
    Do state who the parking company is/was
    Answer these questions:
    Who issued the ticket ( name of parking company ie smart parking)
    Is this a company car, or leased car, and are you/is your wife the registered keeper?

    Next Wait for them to write to you/the registered keeper, and while your at it have a read of the newbies thread

    A grace period has not been given at the end of the parking time, this is against the bpa code of practice and should be used alongside anything else used as an appeal. Napier owns car parks as well, is this one owned by them or is it like a retail park or shop car park, please research this to find out

    Do a search on google for this car park, it could be owned by them so a slightly different appeal needs to be done. You have time as you should wait until a notice to keeper arrives within 29-56 days after parking. Unless the vehicle is a hire/lease/company one. Use this time to do some research to bring you up to speed on this scam.

  • No, the area is definitely not owned by the parking company, up until a couple of years ago it was free (public highway - Jengers Mead, Billingshurst, West Sussex), but the landlord of the shopping precinct decided to enforce parking charges

    Okay whilst you are waiting for the NtK to arrive, use your energies on making complaints to the retailers used, scan receipts and ask them why a genuine shopper is being harassed, and go for the landowner as well. You may get this cancelled before anything arrives.

    You are going to need to search the forum for their name and see the issues with this lot. Their t&cs which are part of their contract they are alleging, do suggest the ticket is for 'breach' but the signage itself doesn't necessarily. You'll need a photo of the sign if you can get it as well as reading other Napier threads.

    You will need a stronger POPLA appeal than a bog-standard one, as you'll find on those other threads you get as your search results. Also search on pepipoo.com private parking forum threads for 'Napier' and read them too, any posts about them from the past 6 months. Nigelbb's post above is important and you'll understand more when you've read other similar threads first.
