  • i've just wrote a letter to the court asking if i can pay the lender direct instead of an attachment of earnings, thats what the court has just advised me to do on the court :)

    The first step is to start making a list of values of what is owed.
    Request statements of accounts and send the standard prove it letters to see what they comeback with.
    Often the best way to get a figure is to pretend you might be in a position to pay it off in one go and request the total figure to be paid in each case.

    Once you have this info, then weighing up your options is next as to the next step.
    Advice from anyone official is always pay up or pay some of it as that is why they exist.
    They will not assist with bankruptcy, you are on your own on this road or in the company of the experts on the bankruptcy board.

    If this debt is regulated by the Consumer Credit Act - as I would expect it to be - interest should not accrue on the CCJ. Any claim for interest would be a totally separate debt and whether that could be enforced is highly debatable. More information:


    Both you and I know what the law says and what they do are two separate things and they do continue to add interest on to the total as nobody ever does anything about it.
