Accident Report Form

I had an accident last July in which my car was written off. The accident was not my fault. I spoke to the insurance company yesterday and apparently the other party are wanting to go 50/50 as they are claiming I was changing lanes, although I was stationary at the time so this is untrue. My insurance company are currently checking the damage on the car to see if it fits in with my version of events, but other than this as there are no witnesses they are going to go 50/50 if nothing comes up. I am not happy with this.
Am I entitled to see the other parties accident report form so I can see what it is exactly they claim happened so that I can defend myself or is it confidential?.

You are not entitled to it but you can ask though many insurers dont bother using accident report forms any more and havent for well over a decade.0

Thanks for the reply. I know I filled out an accident report form and my insurer made reference to the other parties form yesterday when I was talking to them so it sound like there is one in this instance.
I will ask if I can see a copy of their report. I was just hoping that their was some legislation which meant I had a right to see it or something.All I ask is the chance to prove that money can't make me happy.

Not explicit to this, but if your insurers have a copy of it they almost certainly will send you a copy just with personal details obscured. Its fairly standard practice to get your customers response to it where ones provided. You just cannot force the third party insurers to give you a copy.
If they say no then you could pay £10 and do a Data Protection Act Subject Access Request which should result in a copy of it being provided as I dont know of any exception that would cover your insurers.0 -
