How many times can a seller replace an item before a refund?

Hello,

In December 2011 I bought a computer part from an online retailer that came with a three year warranty. This worked until May 2012, at which point it failed and so I sent it back and received a replacement.

This worked until November of 2013 at which point the part failed again. For the second time, I returned the item and requested a replacement.

The replacement arrived last Thursday, and it didn't work at any point. It was sealed so it was clearly new, but has not worked at any point.

Since I've had three of the same item now, and all of them have failed, I don't really want the same item again. Could I instead ask for a different brand of the item instead? What are my rights in this situation?

    You can ask, and you might be lucky, but more likely is that they will offer you a partial refund based on the two years use you have had from the part.
  • Which retailer? A lot of them are only offering partial refunds as already mentioned (yes it is legal and fine for them to do).
