Knock for Knock split liability

Ok,

I've been dragged into this cr*p where insurance companies do deals and both parties get screwed.

My insurance company have just quoted a section from the policy saying they have full control over the claim which means what ever they decide goes.

My question is...

what can I do about it? It's not just the money loss - excess + increase in premium due to loss of NCD, but there is a princibple at stake too where I feel I was not at fault!!

damn it I was not even going to claim expenses either!!

    basically the insurance companies do this because its easier and cheaper for them rather than fight in court over who is to blame. i have just had a little bump which i feel was not my fault but cannot be proved. it could cost my company a fortune to fight it so they go knock for knock and call it a day.
