Swimming lessons

Hi everyone,
My husband and I bought our 4year old daughter swimming lessons, an 8 week course. However, 2/3 weeks in she became unwell with an abscess in her ear. This abscess burst and her ear was weeping for 2 weeks and she was slightly deaf for an additional 2weeks. I informed the instructor that she was unwell and when the doctor diagnosed her we informed them again. He told us that he'd "sort something out" for us.
We asked if we could do the lessons that she's missed. We don't want a refund, just the services we've paid for-pick up where we'd left off
since we paid upfront.
I was just wondering what our rights were. Help!

    Goodwill, as he said he will sort something out so I assume the instructor will let you continue where you left off.

    The legal position is slightly different, the lessons were there for you daughter but she missed them, they don't need to replace the lessons but that would be cruel.

    As bris says, there is no legal right to anything. From a contract point of view, they upheld their side but you broke your side. I acknowledge it wasn't your fault, but then nor was it theirs.

    What you get probably depends on how nice they are feeling, and how busy they are. If the lessons are oversubscribed then they'd be taking a financial hit by allowing your daughter to take them in the future.
