Definition of clear notice.

Hi,

I have just handed my notice in on a property I rent and the landlord has advised my tennancy would officially finish at the end of february as I need to give a months clear notice.

Is this correct? I also started the tennancy on the 20th of the month, does that have a bearing on this?

I'm not trying to get out of a debt that I genuinely owe but this does feel a little sharp.

any advise would be gratefully received.

    Are you in a fixed term tenancy and when does it end?

    Are you in a periodic tenancy, one that automatically takes place if the previous fixed term has expired and a new contract has been signed.

    In England/Wales or Scotland?

    Assuming periodic tenancy and England, ur tenancy will finish on the 19th feb. Is this the notice u gave?

    "clear notice" is not a formal legal term but in principle means you must give notice timed to your rental period.

    You say the tenancy commences on the 20th so if you give notice before 20th Jan your 1 month notice period runs 20th Jan - 19th Feb and you should be able to leave on 19th Feb. Note you cannot leave on the 20th as you would then have outstayed your notice

    NOTE this assumes you are outside of the fixed period of the tenancy and that you are in a Statutory Periodic Tenancy in England/Wales
