Thanks CIS. The summons states that my Dad is required to say why he hasn't paid the tax so I assume we will at least get a hearing.
The magistrate however cannot refuse to grant the order as the Council Tax summons has been issued correctly - the fact he's waiting for a Council Tax Support appeal doesn't stop the Council Tax being due in the meantime.
It usually surprises people to realise that Council Tax Support/Benefit has no special status in the Council Tax legislation - its treat simply as a payment to the Council Tax account in the same way that a cash payment would be paid (or not paid, as the case may be).I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals.
