MET parking charge For parking at MacDonalds

Hi,

I received a parking charge of £100.00. and of £50.00 if i pay with in 14 days from MET for parking at Macdonalds Restuarant in Southall.

I parked at a Macdonalds retuarant and then went out for few minutes to a cash point. Even though it said it is 90 minutes free cusotmer car park. I got fined in about 30 minutes. The parking attendant says that he asked everyone in macdonalds and the car onwer was not present and so he had fined me.

Upon reading the terms (which i never read before i was fined, as they are too small to be read ) it says its free parking for people only on Macdonald premises for 90 minutes.

I did leave before the 90 minutes and also i bought a drink in macdonalds within those 90 minutes.

As i far i am aware i was in the macdonald premises when i was fined so is it possible to fine when i am at macdonalds.

I appealed to MET and got the rejection from them saying that i have to at macdonalds premises at all times as mentioned in the term and conditions.

I have now recived a POPLA form with the letter. Also i was not the driver of the car.

Please can some send me the template for taking this further and also advise if i have a good chance and what points i should raise and what evidnce do i need in my support.

When i parked, also there was no car park attendant available.

    Yep there's a template set of POPLA appeals linked under 'How to win at POPLA' in the 'Private parking ticket? Newbies please read this first!' sticky thread near the top of the forum.

    There's also another sticky thread (a notice/info/FAQs thread, stuck permanently at the top of any forum) called 'Successful complaints about PPCs'. Look at the links in that one about McDonalds local Managers frequently cancelling MET tickets (post #2 in that sticky thread).

    Try both angles (POPLA and complaint), and if no immediate cancellation by your Manager at McD, please draft your winning POPLA appeal based on the first thread and post it here for advice/suggestions if you want help to perfect it. You have an almost certain chance of winning with our 100% winning templates, never lost against MET yet!

    its definitely NOT a fine , its a parking charge invoice from a private company

    do not use the word FINE at any stage in your popla appeal, only a court or judge can "fine" you

    sseems ok to me apart from post #6 , you say at the beginning that you are the RK and are appealing it, so I fail to see the relevance of the driver not being you, nor naming the driver , seems a pointless excercise and names the driver , which I dont see why or what good it would do

    no gpeol is the usual one you win on, although it may win on no contract etc too

    it wont win on naming the driver or that you werent driving , as RK you are responsible for the car which is why you got the PCN and also why you are appealing to popla as the RK, because surely POFA 2012 makes you responsible if you do not name said driver

    so I would erase point 6 in both sections myself

    Thanks for your reply and I have removed the point 6 as it does not make any sense. As the driver was my partner.

    Now another question is , can I ask for compensation. Like for my time to write letter??

    I am pretty sure that when I was issued the parking charge, I was at the premises sitting outside macdonalds.

    As Not to mention, when is initially appealed to MET they rejected saying, after carefully investigating my appeal, they have rejected it.

    I got the appeal allowed by POPLA.

    They said Met did not give any evidence at all for any terms or even any parking charge.

    Did the parking attendant really go round bothering everyone eating in the restaurant, and queuing to order their food, asking if a particular car was theirs?

    First I've ever heard of it.
