Cap one disputed payment

Hi All
I recently used a secure car parking facility while i was away and my car was damaged while it was there, the owners said scaffolding fell on it but they aren't liable?? That part is now in the hands of my insurers.
I paid for the car park using my capital one card, I believe I didn't get the service I paid for and asked for a refund of the parking fee which was turned down so I asked capital one for a refund who say they are unable to dispute my car parking fee, can this be right, should I leave it at that or try and chase it up?
Any help or advice gratefully received.

    They are able to dispute anything and just are fobbing you off.
    However, the fact that you didn't get the service is very arguable. If you really believe that this is the case, sue the owners (via small claims court) and hold Capital 1 jointly liable.

    That said, so is the 'fact' that the owners are not liable, but your insurance company can handle this better than you.
