Look at it this way - a small claim hearing will just determine whether you pay the PCN amount or not. Look at Napier's website - they trumpet a case they 'won' but the person only paid £80 I seem to recall! There are no large costs (small claims fee 'should' be added but it's about £35 to £50) and you have a chance to win. Tell your partner, even if you don't win at a hearing, there is no CCJ (nothing to affect your credit rating) as long as you then paid.

Nigelbb posted a reply to a defendant last year, words to the effect: 'if you lose at small claims you don't even have to sit on the naughty step'!
