    Yes..that's correct. The two tier system - even more reason not to identify drivers.

    Very handy to know that. But the same points would be made at POPLA such as GPEOL and no authority to take out proceedings to slam dunk them?

    I'm only 15 miles from Luton Airport, it's tempting to have a drive up there one day and see if I can get a little envelope in the post :)

    Yep same points plus the certain winner that the keeper is not liable because the NTK is not a POFA2012 document and so is incapable of establishing 'keeper liability'. Easy win for anyone who doesn't imply who the driver was, easier than ever so the 2 tier system backfires on these PPCs.

    APCOA were stuck though because they were sussed wrongly issuing 'POFA' NTKs at Airports and reported to the BPA by some members here. So this was their only way forward! Another PPC, VCS are at other Airports and still using NTKs with 'POFA' cited on them because they haven't yet been stopped by the BPA for some reason. APCOA had more to lose and fell in line quicker I suspect, being a large firm which also has Council contracts.
