(remember I also said he has to give 90 days notice to terminate his contract). He is off for a couple of days next week - dental appointment & a problem with the car but is using holidays up (minimum holiday entitlement so has to use up) but will most likely still have to go in at the weekend to make up for the time he is off.
90 days notice? Even if he does manage to find another job, surely no employer will wait 90 days!

Rule of BoP.previous place wanted 5 hours unpaid OT every week. The rush to get out at CoP everyday, was incredible. No OT worked!

Lucky? So sorry to react to your comment but are you working 7 days a week with 2 to 3 hours added on the week days and then at the weekend up to 8 hours a day non-stop? Also the time off - he can't actually take it off because the company are too busy to let him and the supposed bank hours (because of year end) have gone towards when he eventually leaves (remember I also said he has to give 90 days notice to terminate his contract).
The job in question was 5 1/2 days per week. 8.30am to 6.30pm and 8 to 1pm. 6 days @ 2 hours pd extra even at NMW would be around £3700 per year that I didn't get paid for nor time off in lieu. And I couldn't pick the day off I had either.
So I did the sensible thing and got a different job. As a manager I had to give 90 days notice too. I didn't after explaining it to my new employer who said 30 days and we're not interested in a reference from them other than confirmation that I'd worked for them.
It sounds to me like both you and your husband are frightened (due to past redundancy maybe) to look for another job.
He's been there long enough to look work steady and unless it's common practice in his industry to have those work conditions (and if they are paying others for their time it doesn't sound like it), he should be able to find something else.
In your shoes I'd contact the CAB for advice. If you look at the link I provided in my previous post you will see that 2 people doing the same job should get equal pay. Based on what you said they are not now.
And yes he is lucky to have a job, many don't and I doubt that you would want the alternative at present.
So before he snaps and walks or even worse, gets ill (health comes first) get some proper advice and start looking for ways to make your lives easier.
Don't let the fear of unemployment take control. Between you two and the CAB, you will find out your rights and gain confidence to improve this job or to get another one.0 -

the second he makes trouble he will be sacked, so looking for another job needs to be his number 1 focus and stuff the 90 days, hopefully they will try and claim from him, so keep the powder dry and log all unpaid works and less than minimum wage pay.
Saves you having to pay the fee.
