non delivery of items

Hi , ordered some perfume online dec 1 did not turn up and still has not. The company is now telling me because I click on economy delivery which I thought meant timescale , I am not insured to get my money back. When checking there T and Cs it does say economy delivery is not insured.
Am I still entitled to my money back??? I thought the item is still there`s until delivered to me?? so regardless of which delivery I click they are still liable. Am I right or wrong.
Thanks in advance everyone becoming a headache for me now.

What company did you order from? If its a UK company then the item is legally yours when they dispatch it but it is under their care until the moment it is delivered to you, so they are responsible for the missing delivery.0

I've generally used a credit card to pay for on-line stuff: any real problems re non-delivery, and I get in touch with the CC company, who have in the past, 'recalled' the payment (once I show them the correspondence, other evidence that I'm out of pocket)

If you paid by Credit Card and the item cost more than £100 then you have statutory protection from Section 75 of the Consumer Credit Act. The Credit Card company are jointly and severally liable for the contract with the seller so you can make a claim against either of them.
If it was less than £100 then there is no statutory protection. Paying with Credit Card is then no different to paying with Debit Card. You can try and issue a chargeback for non-delivery. It's not a statutory right, but there's a good chance it will be successful if you are still within the timescale.0 -

Hi update for every one wrote letter last week asking for all postage details and documents and I was going to open a small claims agaist them or fraud case if they could not provide the postage details Tuesday item came through, so persistence does work!! thanks for all your help.0
