bit annoyed with o2 (Default Notice)

I have been a o2 customer for 25 months, i have just received a letter from them, dated 07th January, With the heading Default notice, for the amount of £38.77

My payment is due on the 05th January, There is a direct debit set-up on the account, so money should just come out of there, im a little annoyed.

As i was only made aware that a payment didn't come out till the 8th,with them telling me that the payment was late.. so i sorted it out over the phone

money was available for them to take, so where do i stand legally with this?

  • Ask your bank if they tried to take it.

    I've had a company say the bank refused the DD and the bank say the company didn't ask for the money. This was for a renewal though and I never figured out who was to blame.

    Is it a real default notice or a late payment charge?

    I would complain to the phone company in writing and refer to the ombudsman if needed.

  • Wow, that's a bit quick off the mark with a default notice.

    Well, you paid within the time allowed, so all is now well.

    I would go down the complaint route to find out why no payment was taken. After calling them, to make sure the DD is still in place, noting the date and time of the call and the operator spoken to.

    Then, Maybe move companies...

  • I'm with O2 and never had anything so heavy handed when I was late with a payment. This is the kind of letter they'd send if one was 6 months in arrears.

    I have just renewed contract end of last month, because of the good service. I feel a bit done by now.

    I have paid late once, much later, and nothing had been said.

    There is no way they can mark my credit report with a default surely?, 2 days after the payment was due, and only making me aware on the 8th.

    getting a mortgage this year, could be out the window now.

    No they won't. The letter gave you til 21 Jan to pay. The fact you have done this means they will take no further action.

    Do as I suggest and complain. Renewal and DD are probably related.

    They nay do the same next month unless you get this sorted.

    Thanks for your help people, i did complain to them, and they said oh oh oh oh.

    Its an automated letter they send out, why have i never ever seen one before?

    they couldn't explain why the direct debit hadnt been taken. they where going to investigate, and offer me some sort of goodwill gesture. as a sorry.


    I will write a letter anyway, just for future reference. incase they dont follow it through
