Mini bus with cctv hit my car can i ask for footage

    I have a dashcam in my car and I am quite clear that as I am an individual and it is for my private purpose, then I am exempt from the act.

    As the vehicle in question was a passenger carrying minibus, it wouldn't fall under the " individuals private or household purposes" which is why I stated that the minibus owner was correct in what they stated.

    If it was hired to a college and they had students on the bus, depending on the age of the students would the college not have had to inform parents their children had been involved in a bump. And I'm assuming if post 16 college students they would all have been talking about the bump they had in the bus? Can you contact the college?

    I have in car recording but wouldn't hand over footage unless there was a suitable admin fee paid.


    If the footage showed I was at fault, I would be deleting it asap.
  • As it is a company vehicle it certainly is covered by the DPA however it is possible to have the footage edited to protect identities and then provided to you without any DPA issues. Obviously they'd be looking to you to pay for the editing.

    Realistically, whilst DPA is an issue they are using it as an excuse as there are ways around it. You have no automatic right to see the footage and they just dont want to tell you a straight no.

    The police and the courts are the only way to force disclosure, if the tapes still exist of cause.

    If you have involved the police and said its a hit and run, why have the police not obtained the footage from the mini bus?

    Being legally entitled to it is one thing. In fact we're not even talking about that, were talking about footage not being illegal to disclose to you.

    it's a very long way away from third party volunteering the video to you. If it's not in their interest to disclose CCTV footage they won't. Mysteriously camera might not be turned on at the time, hard drive could be deleted, etc etc.

    If business does not want to show footage to police, there is absolutely nothing the police can do. I was assaulted by someone who went to the same gym as me. The assailant was also a member of the gym and I know that they signed in during that day - the assault happened in the gym. Police went in and got mugshots of everyone who signed in that day (from database) and asked me to ID them - the assailant was not on the sheet. The owners deleted him and there was absolutely nothing the police could do.

    They even made an appointment to go and retrieve all the gym users that day giving the gym plenty of time to delete evidence. I told the police that the assailant was pals with the gym owner too - that if they made an appointment to go in they will not find the assailant..

    I see the assailant from time to time visiting the gym. I asked the officer dealing with the incident if I can I do detective work and park outside the gym and look out for him. Police told me no (it was such a long time ago that I forgot the reason he gave). He told me in code "if you happen to stumble into the assailant and feel threatend you should call 999" - basically told me I can't wait for him on the lookout, but if I stumble into him by chance the police can come straight down.

    CCTV is not the be all and end all of it. You just need a witness and photograph of the minibus and your car damage, paint transfer is handy to have and prove beyond reasonable doubt that there was a collision between the two vehicles.

    Most people are bankers with a w when it comes to witnessing accidents. I always stop and leave my details if I witness an accident. But noticed that most people just stare and drive/walk on.

    Someone in that minibus should really come forward as a witness and say that the driver rammed into the vehicle and drove off - but they remain silent.

    Is it a special needs bus? Cos it appears so.

    Just send the owner of the minibus a recorded delivery letter informing them to preserve the recording of the accident in the event that court action is taken against them. Then sit back and let your Insurers deal with it.

    There's the law and there's the reality. Police are going to do sod all for a minor collision between two cars with nobody injured.

    How are police going to get the resources to enforce PACE? Will the police raid the office, seize all the computer equipment and then do a undelete/recovery of all deleted data and then spend countless foresnic police hours trawling through the scrambled data to locate the footage????

    Unless there is murder/terrorism they will not waste their time. Just send a letter out requesting the information. Business will make up a reason for why data is not available (if it is in their interest to not disclose) and then the police will just write to OP and say no video was taken.

    OP just needs a reliable witness who can say without a shadow of doubt that vehicle X hit vehicle y.
