Aviva took money but provided zero cover

Hello, I just got told off for not having car insurance by the MID which mystified me as I have been paying £21.04 out to Aviva by direct debit on a policy since november 2011 when I called them and asked to change over the car policy to me from my ex husband.
They have no record of any policy in my name so have been taking this money and providing no service. All I get told is that they wouldn't have been allowed to just swap a policy so it couldn't have happened. The evidence is there in my bank account and the bank reference for it just gives my ex husbands policy number which they day they can't talk to me about under data protection although the policy did end at the time I thought I had transferred it. Is there anything I can do to get my nearly £500 back?

Ask your bank to refund you under the direct debit guarantee.
Separately make a complaint to Aviva over this.
If you had no policy since 2011, how have you managed to tax the car? Or maybe you never taxed it either?
Also if you have had no policy since 2011, then your NCD will be out of date as most insurers won't accept it after 2 years, so ensure your new insurer is in the picture about this.0 -
Sound like the policy is still active but in your husbands name. Its not your policy so they wont talk to you.
As above did you declare having no claims? That maybe still in use on your husbands policy and not yours to use.Censorship Reigns Supreme in Troll City...0 -
Log a complaint with Aviva and they will look into it.
You could well be a named driver on the policy and its covering your vehicle etc but due to DPA they wont talk to you. MID is not perfect and insurers do make mistakes.0 -

Personally I wouldnt do this YET. If it does turn out to be a simple user error you'll then have a non-payment issue to deal with. Secondly if I am looking at it and trying to decide if to give you the benefit of the doubt etc depending on what evidence both sides have then suddenly getting all the monies unpaid looks suspicious. It wouldnt be the first time people have made up stories to try and cover their tracks0 -

Acknowledged but the cost of driving without insurance is going to be much more than £500 and so personally, even if its not what was directly asked, I would recommend dealing with the insurance issue first and the premiums second.
Assuming that this are resolved and the phonecall found then the policy will be corrected, the criminal offence avoided but the premiums still stand.0 -

Where is there any criminal offence?
The OP hasn't mentioned any criminal offence!
(Though has told us she is now insured under a new policy)0 -
