hi i was wondering if any body can give me any advice on my monthly bank charges. I have an arranged monthly overdraft with santander and they charge me £20 every month i am wondering if i can get these charges back. Also i have read up that if you are on benefits like disability living allowance which i am under section 187 of the social security administration act of 1992 that it is unlawful to take a charge. Any advice would be appreciated thanks.

but ..... an overdraft is repayable on demand and they can withdraw the overdraft or close your account.
They are not taking your benefit money to repay the debt, they are charging you for the use of their service. The charges are being added to the account and the money is not being set off against other debts which is what the legislation is primarily to prevent. Should you borrow the money foc, should Tesco give you beans foc ?
If you do not want them to take benefit money you must do it in advance of the payment going in and probably in advance of each payment going in but I do not think this applies in this case.0 -
