faulty watch, no receipt- whats my rights

hi

my husband bought me a watch on Xmas eve from Ortak (currently in Administration) when i put it on 4 days later i set time etc , took it off at night and put in on next day and time still same, kept checking it and still not working. 2 days later (friday) took it back to the shop but husband couldnt find receipt. They said they had to test it for 24 hrs and would call monday. They called Sat morning saying faulty and would contact Bering on Monday and phone me. I phoned Tuesday and was told my Store manager that Bering said to send it back to them and was told prob about a fortnight before watch back. Manager phoned me today and said Bering have cancelled their account as in Administration so they (Ortak) cant send watch back. I can have refund or send watch back myself. Told her cant find receipt and she says i need one or cant get money back.

Ive read diff advice some saying yes as goods faulty i can receive money back others saying no. ?Unfortunately my daft hubby has no idea where receipt is , he htought it was in the bag which it isnt and he paid cash so cant even use bank statement to prove sale.

Any help would be much appreciated

    How did he pay for the watch? You dont have to have a receipt, proof of purchase is what you need, so a bank or credit card statement showing the payment to the company will be suffice.

    Edit - Ignore that, just seen that he has paid cash. Unfortuantly without any proof of purchase, im afraid your both out of luck :(

    The only thing i have is the guarantee that ORTAK wrote their details on and the date of 24/12. would this be classes as proof of purchase?

    It would probably count for the manufacturer? Maybe go to them direct and try to get the repair that way?

    hi yes think it will def count for manufacturer so i know i can do that but tbh would just rather get money back and get myself another watch. was hoping seeing as they filled it out that it would count towards proof of purchase

    If ORTAK provided you with a written or stamped guarantee then I would suggest that is proof of purchase.

    Quite likely, but the Adminstrators may still have no idea of the amount paid for the watch, making it difficult for them to refund.

    and if they do go into administration proper you could well end up as an unsecured creditor
  • Had an issue with something I bought cash for once. I got them to review the CCTV footage and found me standing at till buying said item, issue was resolved.

    This was only a couple of days later though, and I know some places have a 'tape' for each day that is then re used the following week.
