Returning opened ink?

Sorry if this is in the wrong place but I couldn't see anywhere suitable to put it.

Cartridge world have sold me the wrong ink for my mum's printer. They're almost identical to look at so mum wasn't aware of the problem until she tried to fit it and it wouldn't go. I sent hubby to a different Cartridge World to get another one and they sent him back with the same wrong one. This made me think that there was a problem with their catalogue but when mum checked with another store (they're all under different owners apparently) the guy said that the ones they gave us aren't listed for that printer so it looks like they've just palmed us off with the nearest (wrong) cartridge.

My query is, are they obliged to take the open one back when it was their mistake?

    Have you asked whether they would take it back first?

    If you ring up HO and explain the situation they may even offer you a free correct cartridge for your troubles!

    If you asked their advice then they advised you wrong then it is their problem, If you went in picked the cart off the shelf and bought it then its your problem and it is up to cartridge world wether or not they take it back.

    CW are all franchise owned companies. Take the carts back and just tell them they are the wrong ones and dont fit your printer and see what they say most should just be nice about it and swap them over for the correct ones. If thy start to say no just inform them that you asked for the cart for an xyz printer and you were handed this one and told it was the correct cart.

    Unfotunatly you are going to need to do the process twice as they are 2 different companies you bought from but you shouldnt have a problem.

    Thanks guys, I sent himself in with a not with the printer details on it so it's definitely their fault. I'd say they'll take the unopened one back ok, it's just that the guy in the 3rd store said that he reckoned they wouldn't take the opened one back.

    I'm just making sure I'm forearmed so that I can get a refund first time and don't have to go back to the shop twice.

    If they get sticky I'll ask them to show me where abouts in their catalogue it says that that ink is compatible with my printer.

    I know the sale of goods act states that goods must be fit for the purpose they're sold for, I just wasn't sure if this still applied when the package had been open and therefore not able to be resold.

    I'll right their HO and ask them their stance on it before I head down. Thanks again ;D

    If you never opened it how would you know it's the wrong one?

    Just take it to the shop, opposed to messing with their head office remember they are franchise based. If they try to knock you back tell them they told you it was the one to buy and you took their word for it. They mis sold you the item.

    its not like they will return it to the manufacturer they brand them as cartridge world they are the manufacturer it will just get reprocessed.

    Just to update, hubby took the opened ink back and the guy exchanged it for the (supposedly) right one. I haven't checked it with the printer yet but hopefully it'll do the job. Thanks for all your comments and suggestions.

    We would exchange it at our shop if its our mistake or the customers, most the time we can repackage them so its not too much of a problem.

    Glad you got it sorted

    btw its confusing for us and we run a shop so its bound to be confusing for customers too, the Ink companies change the models of printers and cartridge compatibilites all the time, it a nightmare.
    Just owe Dad £2500 for a new car
