passed date of appeal now debt collector letter is it too late to appeal?

I wondered if anybody can help me/ offer advice on what to do

I received a (window) parking ticket in October and later received a NTK from a company called PCN (NW) ltd for parking outside of a designated space
- the car park is a free permit car park this was on display and my car was not obstructing anything or parked on double yellow lines etc there is also nothing to say a car cannot be parked where I was - the fine was for £100


I ignored both letters and didn't appeal

I have now received a letter from 'Roxburghe' saying they have been instructed by PCN (NW) ltd to collect the money

what I am wondering is,


1) is it now to late for me to appeal against the ticket as it has been passed on - I don't want to keep ignoring it & the money increasing and being taken to court but also do not want to pay if I can avoid it


2) I have read in another thread that this particular company have been removed from the BPA and so where does this leaves me in terms of appealing etc?

    They haven't been removed as such - they left to join another trade association (IPC Limited) whose appeal process is somewhat of an unknown just now.

    As I said in your post in the other thread though, Roxburghe are toothless. Unless anyone can advise otherwise then I'd suggest to continue ignoring until and unless you get an LBA/LBCCC or actual court papers.

    With the company changing hands does that mean I cannot get a POPLA code from them if I did try to appeal?


    would you advice to appeal or is it a waste of time if Roxburghe are as you say toothless?

    you are in theory too late for a popla code, and now they arent in the BPA you wont get one anyway

    ideally you complain to the landowner and insist on a cancellation

    Actually I would write to PCN(NW) with a fairly strong appeal asking for a POPLA code, if the paperwork you received so far tells you that it is your appeal option. If they've issued a Notice saying part of that alleged 'contract' offers you POPLA (which a PPC can offer at any stage in fact) then IMHO you want to try to draw out a response on that point. So write without telling them you know they aren't in the BPA. Write as if you are expecting to get a POPLA code as normal, and write only as the keeper, as normal (not talking about the parking or driver).

    Roxburghe are toothless so you can safely ignore them (but keep ALL letters). However, PCN(NW) have started a couple of court claims in 2013, which they dropped I seem to recall when they saw a decent defence, so IMHO it's better to write a really reasonable but strong letter of challenge as the registered keeper. As per the examples in the newbie thread about 'robust response' where it says 'if you think you are too late, appeal anyway'. Loads of links in the newbies thread to choose from.

    If unsure, run the wording past us first on this thread.
