Debt recovery letter

I'd pulled up in the dead end of a roundabout junction, on the approach rd to an airport. I received a VCS letter with a photo. The junction has since had bollards put up to block it. I was parked up for a maximum of 3 minutes, so I could check on my phone that my Aunties flight had arrived.

I received a "parking charge notice" from VCS in September. After reading up on the subject I took the view that this was unenforceable, and ignored it. Reviewing the forum now it appears that was probably outdated advice.

Today I have received a "demand for payment of an unpaid parking charge" to the tune of £149, from Debt Recovery plus ltd. It is worth noting that the creditor is listed as "Excel Parking services Ltd" and also the vehicle registration is different to mine (this may not be relevant).

Having read the forum today, I understand that I would have been better appealing. Is it now too late to do this?, what should I do now?

    it was VERY outdated advice given that the POFA 2012 regulations came in in oct 2012 and you checked on here 12 months later in sept 2013 !

    also the advice on here changed around easter 2013 to appeal to the PPC and then to popla so your checking 6 months later didnt seem to find it ? (even though the sticky thread is right near the top of the forum)

    vcs is a sister company to excel so as usual the DR company are misrepresenting it

    I am sure you will receive more advice soon, its never too late to appeal or to complain to the landowner however, or to their managing agents

    The advice that parking charges are unenforceable has not changed, because on the whole they are unenforceable contractual penalties .
    What has changed is the advice on how to deal with them, because at present until it changes the board has worked out a way to have it cancelled and cost them money as well.

    A bit of a two for one.


    Some however are wetting the bed a bit too much and helping the parking companies frighten people with shouty text.

    If anyone gives you any invoice, they can sue you in court for non payment
    that poistion has never been any different, even an invoice for stepping on pavement cracks .
    The difficulty starts if you defend the case as it does with all CCJ claims.
    Then they have to prove the loss, which most can not.

  • I've been in communication with vcs and the debt recovery firm that has contacted me. Long story cut short, I'm being told that its outside of VCS's appeal window and that I should pay the money owed. Reading up on here and on the citizens advice website, I'm increasingly confident in my case should it go to court.

    Would it be possible to send the correspondence to someone on here privately So I can be reassured please? I am fairly sure that the debt recovery firms will monitor this forum. Obviously I'd post all correspondence on here once the situation is resolved.

    Seriously please just get on with your life and forget this trash. You do not have to keep quiet about DRPlus letters! Sorry to say due to various family issues & job, I don't have time to handle pm's and nor do many others.


    But this is basic stuff, easily researched by searching the forum for the word 'Recovery'. You'll be reading threads from EVERY single day for the past year or more about DRPlus - it would take until next Christmas just to read the results on this forum alone - which is why there really are no further questions that haven't already been covered umpteen times. It's all about just doing a keyword search and also reading the sticky threads.

    Do the masses of pictures of ignored letters from six/seven years ago, on the ''PPC letter chains'' sticky thread (click on the old pre-POFA link on that sticky) not reassure you?

    Do tospig's photos of their 'collection' of over 35 letters from DRPlus not reassure you? Linked in the ''NEWBIES'' sticky thread under 'debt collectors'.

    Does this old but still true pepipoo info from 2007 not reassure you?

    Nothing has changed. The POFA 2012 doesn't even apply on Airport land where you describe, so there is no keeper liability. Everyone has always ignored these letters for years. All you did was missed the trick of POPLA, which you would have won and it would have stopped the junk mail. You've missed nothing else and are playing it by the old way - why not Google ''Watchdog dealing with private parking tickets'' and watch the video with the Solicitor (pre-POFA but your case is similar because it's non-POFA). That is what you are doing now, it's no biggie and you are not even liable as keeper!

    You are simply ignoring the same old letter chain that everyone here has done for many years; most of us here have a collection of such letters.
