Tenants don't want to leave

I rent out my house on a short tenancy agreement. I gave the tenant two months notice but they were not happy. I have offered an extra two weeks.

I sent an e mail message asking if we are in agreement on the leaving date. Four days later no reply so I asked by text.

Th tenant is saying I am harassing her and she has young children and will be homeless.

I have always made it clear that I will be returning to sell my home as I cant afford it. So after two years I need to go home to sell.

By the way, I have been living in a caravan saving my money.:(

    None of that matters. Despite the fact this was your home once upon a time, it is currently your tenant's home and you must follow the legal procedures to remove your tenant and put aside all emotion.

    Did you take a deposit and if so is is in a recognised scheme?
    Did you issue a Section 21 notice, and if so, when?
    From now on do everything by the book. Do not text or phone. Just do the proper paperwork and things will take the course.

    Did you issue a valid S21?
    If so, then you might of invalidated it by offering another 2 weeks and would need a new one
    If not then I believe you need to anyway.

    Either way it'd be 2 months again, and that's just notice that you wish to gain the property back, it doesn't mean they have to leave, so it'd then be down to the courts to do it.

    (Mad - you probobly invalidated the S21 (assuming you served one!)

    Stop emailing/texting
    Do this properly, by letter.
    Make sure you know the procedure, and follow it.

    Read Protection from Eviction Act 1977 This is not harassment.... yet. But be careful.
    Her children and homelessness are not your concern in your business venture

    Rosie - I am afraid this all sound s a bit unprofessional and renting a house is a buisness not a pass time. You do need to respond to GMs answers above to get any useful information here.

  • She's playing the "Its not me I'm worried for...its my children" card. Can you in return play the "It's my home and I need it to live in myself" card?

    I have a vague idea that someone cannot be denied the right to live in their own home if they need to (ie because they don't have anywhere else to live)...but I couldn't vouch for that. Suggest you google as to whether your tenant can legally make you homeless by refusing to allow you to move back into your own home.

    The tenant dosent have to leave until the courts say so. Moneystootighttomention the owner cannot just move back in when they fancy, they have to follow the right steps or at least bribe the tenant.

    There is a rule that allows quicker processing of eviction when someone wants to move back into their own house.

    The best thread on this got pulled (Suzy Butler).

    However, to use this mechanism you have to inform the tenant in writing before they sign the tenancy agreement that this is your only home and that you may want it back.

    Yes, they can. The tenant is not doing anything wrong by living in the house they are legally entitled to. It is the OP making themselves homeless not the tenant.

    As above, the OP needs to treat this like the business it is. No emotion. Follow the rules (S21) and do it properly otherwise the OP could quickly find themselves on the end of some serious consequences.

    It is a Sec 8 citing ground 1, but it requires 2 months notice.
    I don't know whether it is 2 months straight, or 2 months also expiring at the end of a tenancy period.

    Some tenants do not want to leave the house until they get orders from court. Because tenant gets love with rental house and want to become owner of that house.

    is this some bizarre spamming effort?
